WASHINGTON – The U.S. Equal Employment Opportunity Commission announced Monday it is suing a company for allegedly subjecting transgender employees to harassment.

The lawsuit is against Starboard Group, Inc. doing business as Wendy’s, and Starboard with Cheese LLC, as a case in the U.S. District Court for the Southern District of Illinois.

According to the lawsuit, the agency charged that the Wendy’s location in Carbondale subjected a class of transgender employees to pervasive sexual harassment including repeatedly subjecting the transgender employees to misgendering, graphic sexual comments, unequal access to bathrooms, intrusive questions, and degrading conduct based on gender identity.

The lawsuit was filed to enforce Title VII of the Civil Rights Act of 1964 (Title VII) which forbids discrimination based on sex.
